1 Acceptance of Terms

By accessing or using the website at realwebstudio.com, submitting a contact form, placing an order, or using any of our services, you ("Client," "you," or "your") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

These Terms constitute a legally binding agreement between you and Real Web Studio ("RealWebStudio," "we," "us," or "our"), a business registered in Alberta, Canada.

If you do not agree to these Terms, please do not use our services. We reserve the right to refuse service to anyone at our sole discretion.

2 Our Services

RealWebStudio provides done-for-you digital services for small businesses, including but not limited to:

• Custom website design and development
• Website hosting, SSL certificates, and maintenance
• Search engine optimization (SEO)
• Automated social media content creation and publishing
• Google review request automation
• Lead generation and automated follow-up systems
• AI-powered chat and voice agents
• Website migration from other platforms
• Full online presence management (Custom Plan)

The specific services included in your plan are detailed at the time of purchase. Service features and inclusions may be updated from time to time with reasonable notice to existing clients.

3 Account & Eligibility

To use our services, you must:

• Be at least 18 years of age
• Be a legal resident of Canada or operate a business in Canada
• Provide accurate, complete, and current information when submitting a request or placing an order
• Maintain the security of any login credentials provided to you

You are responsible for all activity that occurs under your account. If you believe your account has been compromised, notify us immediately at [email protected].

4 Pricing & Payment

Current Plans

• Starter — Monthly: $9.99 CAD/month + $199 one-time setup fee
• Starter — Annual: $119.88 CAD/year (setup fee waived)
• Custom Plan: Pricing provided upon request based on scope

Billing

Monthly plans are billed on a recurring basis on the same calendar date each month. Annual plans are billed once per year. Payment is due at the time of purchase and on each renewal date.

We accept major credit cards and e-transfer. All prices are in Canadian dollars (CAD) and are subject to applicable taxes.

Late or Failed Payments

If a payment fails, we will notify you and attempt to collect payment within 7 days. If payment is not received within that period, we reserve the right to suspend your services. Services suspended for non-payment will be restored promptly upon receipt of the outstanding balance.

Price Changes

We reserve the right to change our pricing at any time. If you are an existing client on a monthly or annual plan, we will provide at least 30 days written notice before any price increase takes effect for your account.

5 Refunds & Money-Back Guarantee

Eligibility for Refund

• Refund requests must be submitted within 14 days of the website going live
• The refund covers your monthly or annual subscription fee
• One-time setup fees ($199) are non-refundable once design work has commenced
• Refunds are not available for Custom Plan engagements where significant custom work has been delivered, unless otherwise agreed in writing

How to Request a Refund

Email us at [email protected] with the subject line "Refund Request" and include your name, business name, and reason for the request. We will process eligible refunds within 5–10 business days to your original payment method.

Cancellations

You may cancel your subscription at any time by contacting us. Cancellations take effect at the end of the current billing period. We do not provide partial-month refunds unless the 14-day guarantee applies.

6 Scope of Work & Delivery

Website Delivery

We aim to deliver your completed website within 3–7 business days of receiving all required content from you (text, images, logo, business details). Delivery timelines may be affected if client-provided content is delayed or incomplete.

Revisions Before Launch

We offer unlimited revisions before your website goes live. Once you approve the design and we launch, any subsequent changes are handled under our standard ongoing maintenance terms.

Post-Launch Changes

After launch, minor content updates (text changes, image swaps, contact information updates) are included as part of your active subscription. Major redesigns or additional pages beyond the original scope may incur additional charges, which will be communicated to you before work begins.

Starter Plan — Page Limit

The Starter plan includes up to 5 custom pages. Additional pages can be added at an agreed rate.

7 Intellectual Property

Your Content

You retain full ownership of all content you provide to us, including text, logos, images, trademarks, and other materials ("Client Content"). By providing Client Content, you grant RealWebStudio a limited, non-exclusive license to use, reproduce, and display that content solely for the purpose of delivering your services.

You represent and warrant that you own or have the right to use all Client Content you provide, and that it does not infringe the intellectual property rights of any third party.

Our Work Product

Upon full payment of all outstanding fees, you receive a license to use the website we build for you as long as your subscription remains active. If you cancel your subscription, your access to the hosted website will be discontinued unless alternate hosting arrangements are made.

Our underlying design templates, code frameworks, and proprietary systems remain the intellectual property of RealWebStudio. These are licensed to you for use, not transferred or sold.

Portfolio Rights

We reserve the right to display your completed website in our portfolio and use screenshots for marketing purposes unless you request otherwise in writing.

8 Domain Ownership

Your domain name is always yours. Whether you register a new domain through us or bring an existing one, you retain full ownership and control of your domain at all times.

If we register a domain on your behalf, we will provide you with full registrar access credentials. We will never hold your domain hostage or transfer it without your explicit written authorization.

If you cancel your service, you keep your domain. We will assist with pointing your domain to a new host if needed.

9 Your Responsibilities

To ensure we can deliver your services effectively and on time, you agree to:

• Provide accurate, complete business information and content when requested
• Respond to our requests for feedback, approvals, or additional content in a timely manner (typically within 3 business days)
• Ensure that all content you provide — including images, text, and other materials — is legally owned by you or properly licensed for use
• Keep your billing information current and pay all fees on time
• Notify us promptly of any changes to your business name, contact information, or service requirements
• Use the services only in compliance with all applicable Canadian and provincial laws

10 Prohibited Use

You may not use RealWebStudio's services to create, host, promote, or facilitate any content or activity that:

• Violates any applicable law or regulation in Canada or any other jurisdiction
• Infringes the intellectual property, privacy, or other rights of any third party
• Is defamatory, fraudulent, misleading, obscene, or harmful
• Promotes violence, hate speech, or discrimination on the basis of race, gender, religion, sexual orientation, disability, or other protected characteristics
• Involves illegal products or services, including unlicensed cannabis sales, illegal gambling, or weapons trafficking
• Contains malware, viruses, or any malicious code
• Involves unsolicited mass communications or spam in violation of Canada's Anti-Spam Legislation (CASL)
• Impersonates RealWebStudio or any other person or organization

We reserve the right to suspend or terminate services immediately and without refund if we determine, at our sole discretion, that you are engaging in prohibited use.

11 Termination

Termination by You

You may cancel your subscription at any time by contacting us at [email protected]. Cancellations take effect at the end of your current billing period. You will not be charged after cancellation.

Termination by Us

We may suspend or terminate your services with notice in the following circumstances:

• Non-payment of fees after a reasonable grace period
• Breach of these Terms of Service
• Prohibited or unlawful use of our services
• Abusive, threatening, or harassing behavior directed at our team

In cases of serious or repeated violations, we may terminate immediately without notice or refund.

Effect of Termination

Upon termination, your website will be taken offline at the end of the billing period. You retain ownership of your domain and any content you provided. We will assist with exporting your content upon request within 30 days of termination.

12 Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, to the fullest extent permitted under Canadian law.

We do not warrant that:

• Our services will be uninterrupted, error-free, or completely secure
• Your website will achieve specific search engine rankings or business results
• Our services will meet every specific business requirement you have
• Any errors or defects will be corrected within a specific timeframe (though we make every effort to resolve issues promptly)

13 Limitation of Liability

To the maximum extent permitted by applicable law, RealWebStudio and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — our services, including but not limited to:

• Loss of business, revenue, or profits
• Loss of data or content
• Loss of goodwill or reputation
• Any damages resulting from third-party services we use (e.g., hosting providers, payment processors)

In any case, our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount you paid to us in the three (3) months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above may not apply to you in full. In those cases, our liability will be limited to the greatest extent permitted by law.

14 Indemnification

You agree to defend, indemnify, and hold harmless RealWebStudio, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of our services in violation of these Terms
• Any content you provide that infringes the rights of a third party
• Your violation of any applicable law or regulation
• Any misrepresentation you make to us or to third parties in connection with our services

15 Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Dispute Resolution

If you have a dispute with us, we encourage you to contact us first at [email protected]. We are committed to resolving disputes quickly and fairly.

If we cannot resolve the dispute informally within 30 days, either party may pursue the following options:

• Small Claims Court — for claims within the jurisdictional limit of Alberta's Provincial Court (Civil Division)
• Mediation or Arbitration — both parties may agree to binding arbitration as an alternative to court proceedings
• Alberta Courts — for any claims not resolved by the above methods, the courts of Edmonton, Alberta shall have exclusive jurisdiction

16 Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Post a notice on our website for at least 30 days
• Send notice to active clients by email where required

Your continued use of our services after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the changes, you may cancel your subscription before the changes take effect.
